Chapter 13: This type of bankruptcy is for those individuals or small businesses who can afford to re-pay some of the debt they have accrued. The Chapter is officially entitled Individual Debt Adjustment and, in many ways, this type of bankruptcy amounts to a repayment plan. The good news for those who apply for this type of bankruptcy is that, in most cases, they only have to pay creditors what they can afford to pay so long as it is as much as what they would have received in a Chapter 7 type payment. It is important to note that no balance is charged on repayments of this nature, this means that the balances are fixed from the time of filing. The benefits of Chapter 13 type bankruptcy is that it allows homeowners to remain in their home without fear of eviction. From a tax debt perspective, Chapter 13 type debt is used to repay any outstanding tax that wasn’t discharged from a Chapter 7 proceeding.
