Grounds for Divorce?

While, the grounds for divorce differs from state to state in the U.S., there is a general consensus regarding three instances where the breakdown of a marriage should lead to grounds for divorce being granted.

  • 1. The spouses have lived apart in separate residences for at least one year in advance of the divorce proceedings, and continued to so as the divorce proceedings begin and progress.
  • 2. One or both spouses have brought the marriage into disrepute by committing adultery.
  • 3. One or both spouse have committed physical or mental cruelty to the other in a deliberate way that would make the possibility of both spouses living together intolerable.

How Does a Family Court Divide Property?

When a marriage comes to an end, there are a wide range of issues that need to be resolved. Everything from child custody arrangements to identifying a new place to live can really take its toll.   • 2. Examine the history of the marriage and ascertain the contribution made be each spouse to acquire, conserve and improve the assets, resources as well as any relevant contributions towards the welfare of the parties’ family.
  • 3. Finally, looking forward, the family court judge will ascertain and examine a number of factors to determine if any other fiscal adjustments need to be made in favor of one party or another.
